The Growing Consumer Exposure to Nanotechnology in Everyday Products: Regulating Innovative Technologies in Light of Lessons from the Past by Creating a “Public Health Product Safety Net”

This presentation will broadly touch on the public health, regulatory, legal, and ethical issues raised by the developing appreciation of the health risks associated with nanotech products. More specifically, the following will be covered: (1) the present scientific understanding of the health risks associated with the consumption of nanoparticles; (2) the existing FDA regulatory structure that governs food, dietary supplements, cosmetics and sunscreens and whether these regulations adequately protect public health when applied to the nanotech versions of these products; (3) whether the tort system can provide a remedy for a consumer who is injured from unavoidable exposure to nanotech ingredients; and (4) a proposal for an alternative method of regulating nanotech products that protects public health while encouraging technical innovation through the use of big data strategies to animate the “public health product safety net.”

Speaker Information Katharine Van Tassel Tassel has joined Case Western Reserve University School of Law as a visiting professor, starting this fall. Van Tassel has a BSN and JD from Case Western Reserve University, an MPH in Law and Public Health Policy from Harvard University, and will complete an MS in Food Safety from Johns Hopkins University in 2020.

She was previously with Creighton University School of Law as Professor of Law and director of health law programs, Associate Dean & Professor of Law at Concordia University School of Law, and most recently Dean and Professor of Law of San Francisco Law School.

Van Tassel’s areas of expertise include health law, food and drug law, and public health law.
